Unfair Dismissal
Following legislation introduced in October 2004 your employer must have followed a statutory procedure when dismissing you. Failure to do so will render your dismissal automatically unfair. This means that as a minimum, your employer must have:
- Your employer must set out in writing the alleged conduct or characteristics, or other circumstances, which have led them to contemplate dismissing you. This should be sent to you, inviting you to a meeting to discuss the issues. You should have sufficient time to prepare for this meeting (at least 24 hours).
- The meeting must take place before any action is taken. You must attend this meeting.
- You should be given the right of appeal against the decision.
In addition to this, you have the right to be accompanied at all formal stages of a disciplinary procedure by either a work colleague or a certified trade union official.
