Dismissal
There are 2 ‘types’ of dismissal which can lead to claims at Employment Tribunal. The first is where your employer has directly dismissed you, commonly referred to as Unfair Dismissal. Examples of this include dismissals for:
- Long term sickness absence;
- Performance issues;
- Misconduct;
- Redundancy;
The other is where you have resigned from your employment as a direct result of something that your employer has said or done to you which has destroyed the working relationship. This is commonly referred to as Constructive Dismissal.
